Workshop Focus
We will unpack the recent court decision in WorkSafe v Gibson, specifically considering officers’ liabilities in terms of:
- Ensuring the PCBU has available for use, and uses, clearly documented, effectively implemented, and appropriate safety measures.
- Ensuring the PCBU has available for use, and used, clearly documented, effectively implemented, and appropriate processes for ensuring coordination between employees.
- Verifying the provision and use of these resources and processes.
We will then explore the New Zealand Government’s proposed changes to officers’ liability under the Health and Safety at Work Act 2015, which propose to clarify the distinction between governance and management health and safety responsibilities, notably:
- Officers (e.g. directors and CEOs): will be responsible for strategic oversight and governance.
- Managers and executives: will be responsible for day-to-day health and safety risk management.
