Topic:

The New Zealand government adopted emergency measures in order to manage the spread of COVID-19 and its effects. These measures required compromises on usual legal and political safeguards taken as necessary in more usual times, including the suspension of Parliament and the delegation of its oversight responsibilities to the cross-party Epidemic Response Committee chaired by the Leader of the Opposition. In this webinar, three noted legal contributors speak to whether New Zealand struck the right balance between upholding the rule of law on the one hand, and responding appropriately to an exceptional crisis on the other. This has important implications not just for now, but also for the possible use of emergency measures in future crises (real or imagined). Each speaker will present four around 15 minutes, following which there will be around 15 minutes of moderated Q&A.

Speaker Details:

Roger Partridge is chairman and a senior fellow of The New Zealand Initiative and is a regular media columnist on a wide range of public policy issues. He is a former chair of law firm Bell Gully. Roger is an Honourable Fellow of the Legal Research Foundation and is a past member of the Council of the New Zealand Law Society. Among his recent publications is a research note entitled The rule of law or the law of rulers examining the rule of law implications of the Covid-19 lockdown.

Dr Edward Willis is a legal academic and consultant specialising in public law issues, based at the University of Auckland. His research has a particular focus on questions of constitutional structure, the limits of government power and the nature of the regulatory state. He has been a regular commentator on the New Zealand Government's legal response to the Covid-19 pandemic.

Dr Dean Knight is an Associate Professor in the Faculty of Law and NZ Centre for Public Law at Te Herenga Waka—Victoria University of Wellington. His teaching and research interests lie in public law generally. He has written and commented widely on legal aspects of the government's response to the Covid-19 pandemic.
